I just bought a hyper 212 evo to replace my wraith spire cooler. my question is do i need to take the old bracket and replace with the one that came with the hyper 212 or can i just use the same bracket.

The stock backplate must be removed and then place the provided backplate there.

 

Tumb of rule if the cooler comes with own backplate you must use it.
Bad mount with excessive weigth could warp or damage the motherboard without the proper backplate.

I have this problem, in your pic it seems like the CM backplate doesn't fit your mobo holes. Is that the case? I have that problem.

My bad, you're right that's not the 212 backplate for AM4.
It's the old backplate.

 

The 212 Evo comes now with the new toolbox for AM4.

The new backplate fits both AM3 and AM4 sockets:

But the AM4 upgrade kit RR-AM4B-H212-S1 (sold separetely) uses the stock backplate:

Well I would say if the cooler comes with the backplate it should be used.
Unless the mounting system is designed to use the stock backplate.

The current way to mount without the AM4 upgrade kit mounts the cooler in the incorrect position with the fan being up/down and not left/right.

 

The AM4 upgrade kit should be included with the cooler, but Cooler Master is lazy and has cheaped out.

 

I've contacted support but they can't be bothered to respond in over 4 weeks.
